Sí, durante el período de prueba cualquiera de las partes puede dar por terminada la relación laboral sin responsabilidad.
Según el artículo 80 del Código Sustantivo del Trabajo de Colombia, el período de prueba no puede exceder dos meses. Durante este período cualquiera de las partes puede terminar el contrato sin preaviso ni indemnización.
Sin embargo, hay excepciones importantes:
- Si la trabajadora está embarazada, aplica el fuero de maternidad (Art. 239 CST)
- Si el despido es discriminatorio, puede ser impugnado independientemente del período de prueba
- El período de prueba debe constar por escrito, de lo contrario se entiende que no existe (Art. 77 CST)
